USER AGREEMENT

THIS DOCUMENT IS THE OFFICIAL USER AGREEMENT ("Agreement") between you ("User", "you") and the developer of the Imagionica mobile application — Sreda Izrabotka EOOD ("Company", "we", "our"). This Agreement governs your rights and obligations when using the Imagionica mobile application ("App"), distributed through the App Store and Google Play in the European Union, USA, and other jurisdictions.

1. Acceptance of Terms 1.1. By using the App, you accept the terms of this Agreement in full. If you disagree with any provision, you must stop using the App immediately. 1.2. The Company reserves the right to modify this Agreement. The updated version becomes effective upon publication in the App or on the official website. Continuing to use the App after changes signifies your acceptance of the updated terms.
2. Services Description 2.1. Imagionica provides tools for creating collages from your photos and built-in design elements (stickers, backgrounds, fonts, etc.). 2.2. No registration or account is required — you can freely create and save collages without an account.
3. License 3.1. Subject to your compliance with this Agreement, the Company grants you a limited, non-transferable, non-exclusive, and revocable license to install and use the App on your personal iOS and Android devices. 3.2. You may not: a) copy, modify, distribute, rent, or lease the App; b) decompile, disassemble, reverse-engineer, or attempt to discover the source code of the App; c) transfer any rights to third parties; d) use the App for commercial purposes without the Company’s prior written consent.
4. Subscription and Access to Premium Content 4.1. The App is free to download, but certain content packages (stickers, backgrounds, fonts, etc.) are available only via subscription. 4.2. Subscriptions are purchased and renewed through the App Store or Google Play mechanisms. 4.3. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Renewal charges occur within 24 hours prior to the end of the current period. 4.4. You can manage or cancel subscriptions and disable auto-renewal via your App Store or Google Play account settings after purchase. 4.5. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription. 4.6. Subscription content (stickers, backgrounds, fonts) has been acquired or licensed by the Company from third-party stock content providers under terms allowing commercial and free use. 4.7. Refund policies are determined by the rules of the respective application store.
5. Intellectual Property 5.1. All rights to the code, design, trademarks, and built-in elements (stickers, fonts, backgrounds) belong to the Company or its licensors. 5.2. You retain ownership of any photos or other materials you upload. By uploading such content, you grant the Company a non-exclusive, royalty-free license to store, display, and process it solely within the App. 5.3. You warrant that you own or have the right to use all uploaded materials and that they do not infringe the rights of third parties.
6. User Content 6.1. You are solely responsible for any content you create or share using the App. 6.2. You may not publish or distribute content that violates any laws or contains pornography, hate speech, violence, or discrimination. 6.3. The Company reserves the right to remove any content that violates this Agreement without notice.
7. Handling Third-Party Copyright Claims 7.1. If a copyright holder believes that the App contains content used without authorization, they may send a claim to imagionica@sredadev.com, including the basis for the claim and supporting evidence. 7.2. The Company will promptly review any such claim and, if a violation is confirmed, remove the disputed content or take other appropriate action.
8. Privacy Policy 8.1. Data collection and processing are governed by the Privacy Policy, which is an integral part of this Agreement. 8.2. The Privacy Policy describes the types of data collected, purposes of use, User rights, and compliance with GDPR, CCPA, and other applicable laws.
9. Disclaimer of Warranties and Limitation of Liability 9.1. The App is provided "as is" and "as available." It may contain bugs, and the Company will make reasonable efforts to fix them but does not guarantee the elimination of all issues. 9.2. The Company does not warrant uninterrupted operation of the App or that its functionality will meet specific user requirements. 9.3. To the maximum extent permitted by law, the Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.
10. Dispute Resolution and Governing Law 10.1. This Agreement is governed by the laws of the country of the Company’s registration (Bulgaria) and, where required, by the laws applicable to the User. 10.2. Any disputes arising under this Agreement will be resolved through negotiations, and if no agreement can be reached, through a court located at the Company’s place of registration.
11. App Store and Google Play Terms 11.1. You agree to comply with all applicable App Store and Google Play policies, including rules on subscription cancellations and refunds. 11.2. You may not use the App or its content in ways that violate the policies of these stores.
12. Modification and Termination 12.1. The Company may suspend or discontinue the App at any time without notice. 12.2. You may stop using the App and uninstall it from your device at any time.
